
Georgia-based giant, Zaxby’s Franchising LLC has filed a lawsuit in the United States District Court Northern District of Georgia against Joella’s IP LLC for trademark infringement.
Zaxby’s Franchising alleges that the defendant is using a logo that is similar to Zaxby’s trademarked logos.
Zaxby’s Franchising reportedly said that the logo consists of a silhouetted chicken at the center of a circle which is typically similar to that of the defendant.
Zaxby’s Franchising claimed that the Zaxby’s logos have gained such widespread consumer recognition and distinctiveness.
Following the lawsuit, Joella’s IP LLC reportedly said that “at Joella’s Hot Chicken, we hold our product and our reputation to a high standard. We take accusations such as these seriously, but are just as surprised as everyone else when looking at these two logos side-by-side. We are currently discussing next steps with our legal team. At this time, we cannot make any further comment in regard to this pending lawsuit.”
Zaxby’s Franchising alleges that the infringement has caused lots of damages, unfair competition and confusion.
The plaintiff seeks jury, permanent injunction and payment for damages.
The case is ongoing.
