U.S. News | YOSHITSU Sues Two Cosmetic Stores on Saipan for Trademark Infringement

A Japan-based company, YOSHITSU Co. Ltd. has filed a lawsuit against two cosmetics stores, American Beauty Corp., American Dong Sheng Corp., their owner Weidong Guo, and 10 “Does” for trademark infringement.

According to the lawsuit, YST claim to be the sole owner of a design trademark “Tokyo Seikatsukan” interpreted as “Tokyo Lifestyle Store” which has been infringed by the two stores.

YST reportedly said that the defendants were granted a revocable, non-exclusive license in April 2018 to use trademark logo of YST in two drug and cosmetics stores on Saipan but the license was revoked in Feb 26, 2019 through a written notice to the stores.

YST alleges that the revoked license was to take effect from March 6, 2019 but till date, neither of the two stores has stopped using the logo and has not taken down the logo from their stores or their van.

YST reportedly said that the defendant’s infringement is using her goodwill, reputation and popularity to persuade consumers even after the license was revoked.

YST alleges that the defendants have violated the provisions of the Lanham Act, a federal statute that prohibits trademark infringement causing confusion, unfair competition and damages.  

The plaintiff seeks jury trial and payment of award up to $2 million as damages for each trademark infringement violation committed by the two stores.

The case is ongoing.
