
Virgin Enterprises has filed a lawsuit in the U.S. District Court for the District of Wyoming against the owner of two companies, Virginic and Paramount Labs alleging trademark infringement, dilution and unfair competition.
Virgin Enterprises alleges that the defendants infringed on its mark by using the “Virginic” to sell cosmetics and personal care products without permission or authorization.
Virgin Enterprises reportedly said that the English High Court denied Virginic’s application to register the Virginic trademark in the U.K. in March because the mark is likely to cause confusion with existing trademarks.
The plaintiff reportedly said that it has tried to collect the U.K. judgment from Virginic, but it has refused to comply.
The plaintiff alleges that the infringement has caused lots of damages, confusion and unfair competition.
“As a result, Virginic now owes Virgin £35,000 ($44,000). Paramount is a sham entity that was created solely to hide assets from the U.K. judgment and continue acts of infringement”, Virgin Enterprises alleges
According to the lawsuit, the plaintiff alleges that following the U.K. judgment in May 2019, the owner of Virginic formed Paramount Labs in Wyoming which imports Virginic goods featuring the same packaging into the United States.
