U.S. News | Texkhan Alleges Two California Businesses Used Textile Design Without Permission

Earlier this month, Texkhan Inc., doing business as HyupSung TRD Co. LTD sued a Santa Fe Springs corporation and a Los Angeles corporation, Windsor Fashions Inc.; Polymond DK Inc., doing business as Millibon; and Does 1-10 alleging in the U.S. District Court for the Central District of California with case number case number 2:18-cv-03794 alleging copyright infringement.

The plaintiff has unlawfully used the plaintiff textile design in clothing which is owned and composed as a two-dimensional artwork known as HA-3156.

The plaintiff alleges the defendants created, manufactured or imported fabric and clothing bearing this design without the plaintiff’s authorization.

The plaintiff holds Windsor Fashions Inc., Polymond DK Inc. and Does 1-10 responsible because it allegedly suffered substantial damages as a result of the defendants’ actions.

The plaintiff requests a trial by jury and seeks judgment against the defendants, accounting of their profits from infringement, attorneys’ fees, prejudgment interest, costs of action, and further legal and equitable relief as the court deems proper.
