A Chicago-based company, Vibes Media LLC, has filed a lawsuit against Kim Kardashian West’s fragrance line for alleged trademark infringement. The case was filed in Illinois federal court, and the plaintiff claims that the design of the defendant’s perfume infringes the plaintiff’s trademarked text-bubble logo.
“In an effort to promote its brand recognition and promote its goodwill, Vibe filed a trademark application for its Registered Vibes Logo on April 23, 2012, with a date of first use of January 2011.” According to the company, the Registered Vibes Log is prominently displayed in the front lobby of Vibes headquarters in Chicago IL.
Vibe claims KKW has been marketing, promoting, and is now selling a Vibes perfume newly released as Kimoji fragrance line having three perfumes including Kimoji Cherry, Kimoji Peach, and, the perfume.
The Vibes perfume comes in a bottle that is a close facsimile of the Registered Vibes Logo the plaintiff claimed.
Vibes is seeking unspecified damages and wants all unsold Vibes bottles destroyed. The case is currently pending.
