This article is part of a series that highlights some of the marks advertised in the Trademarks, Patents and Designs Journal, Vol. 3 No. 1.  The Journal was published by the Trademarks, Patents and Designs Registry in Nigeria on December 31, 2013.  TM Watch No. 19 highlights some of the marks advertised in Class 30 and 32.  Specifically, “Class 30:  In respect of Coffee, Tea, Cocoa, Sugar, Rice, Tapioca, Sago, Artificial Coffee, Flour and Preparations made from Cereals, Bread, Pastry and Confectionery, Ices, Honey Treacle, Yeast, Baking-powder, Salt, Mustard, Vinegar, Sauces (Condiments), Spices, Pepper.” and “Class 32:  In respect of Beers, Mineral and Aerated Waters and other Non-alcoholic Drinks, Fruit Drinks and Fruit Juices, Syrups and other”.

Innscor International Applies to Register “Fish Inn”, “It’s Catchy”, “Fish ‘n Chips It’s Catchy”, and “Fish ‘n Chips” in Class 30 in Nigeria

FISHINNInnscor International (Innscor) has lodged an application for the registration of several marks including “Fish Inn”, “It’s Catchy”, “Fish ‘n Chips It’s Catchy”, and “Fish ‘n Chips” at the Trademarks, Patents, and Designs Registry in Abuja. All applications were filed on December 31, 2012 and cover coffee, tea, flour etc. in Class 30.  Innscor has also registered the marks in Class 30 in Morocco.

The status of the applications in Nigeria as of December 31, 2013, was accepted and approved for publication.

Heineken Brouwerijen B.V. Applies to Register “Heineken” in Class 32 in Nigeria

Heineken Brouwerijen B.V. (Heineken) has lodged an application for the registration of “Heineken” at the Trademarks, Patents, and Designs Registry in Abuja.  The application was filed on April 15, 2013 and covers non-alcoholic drinks in Class 32.

Heineken has registered the mark in Class 32 in several countries including Australia, Canada, New Zealand and the United States.  The status of the mark in Nigeria as of December 31, 2013, was accepted and approved for publication.

Starbucks Corporation D/B/A/ Starbucks Coffee Company Applies to Register “Starbucks” and “Verismo” in Class 30 in Nigeria

STARBUCKSStarbucks Corporation D/B/A/ Starbucks Coffee Company has filed applications for the registration of “Starbucks” and “Verismo” at the Trademarks, Patents and Designs Registry in Abuja.  The application for “Starbucks” is dated June 2, 2011 while the application for “Verismo” was filed on March 7, 2012.  Both application cover coffee, tea, flour etc. in Class 30.

Starbucks has also registered the marks in Class 30 in Egypt, Estonia, Oman, New Zealand and the United States.

The status of the marks in Nigeria as of December 31, 2013, was accepted and approved for publication.

9MM American Beverage Co. Applies to Register “9MM Energy Drink” in Class 32 in Nigeria

9MM9MM American Beverage Co. has lodged an application for the registration of the “9MM Energy Drink” at the Trademarks, Patents and Designs Registry in Nigeria.

The mark consists of a three-dimensional configuration of product packaging in the shape of a 9mm ammunition round, consisting of a gold cylinder having a bronze domed cap . On the cylindrical portion appears a black star above the stylized black wording “9MM” above the stylized black wording “Energy Drink” above the stylized black wording “9MM” above a black star.  The application was filed on February 5, 2013 and covers non-alcoholic drinks in Class 32.

The status of the mark in Nigeria as of December 31, 2013, was accepted and advertised for publication.

Ajinomoto Co. Inc. Applies to Register “Hondashi” in Class 30 in Nigeria

Ajinomoto Co. Inc., has filed an application to register “Hondashi” at the Trademarks, Patents and Designs Registry in Abuja.  The application for the registration was filed on November 2, 2012.  It covers coffee, tea, flour etc. in Class 30.  Ajinomoto has also registered “Hondashi” in the U.S and Canada.

The status of the mark in Nigeria as of December 31, 2013, was accepted and advertised for publication.

Kellogg Company Applies to Register “POP-TARTS” in Class 30 in Nigeria

Kellogg Company has lodged an application to register “POP-TARTS” at the Trademarks, Patents and Designs Registry in Abuja.  The application for the registration was filed on October 19, 2012.  It covers coffee, tea, flour etc. in Class 30.  The status of the mark in Nigeria as of December 31, 2013, was accepted and advertised for publication.

Societe Des Produits Nestle S.A. Applies to Register “Protomalt” in Class 32 and “Calci-N” in Class 30 in Nigeria

CALCI-NSociete Des Produits Nestle S.A. (Nestle) has lodged applications for the registration of “Protomalt” in Class 32 and “Calci-N” in Class 30 at the Trademarks, Patents, and Designs Registry in Abuja.  The application for “Protomalt” was filed on July 18, 2012 while the application for “Calci-N” was filed on February 5, 2003.

WIPO’s Global Brand Database, shows that Nestle has also registered the mark in Class 30 in Singapore and the Philippines.  The status of the marks in Nigeria as of December 31, 2013, was accepted and approved for publication.

Compagnie Gervais Danone Applies to Register “Danone” in Class 30 in Nigeria

DANONECompagnie Gervais Danone has lodged an application for the registration of the term “Danone” at the Trademarks, Patents, and Designs Registry in Abuja.  The mark consists of a rectangular carrier with two curved sides and the word “DANONE” appearing in white above a red curved line. The application was filed on February 24, 2005 and covers coffee, tea, flour etc. in Class 30.

WIPO’s Global Brand Database, shows that Compagnie Gervais Danone  has also registered the mark in Class 30 in Israel, Singapore and the Philippines.  The status of the mark in Nigeria as of December 31, 2013, was accepted and approved for publication.
