This article is part of a series that highlights some of the marks advertised in the Trademarks, Patents and Designs Journal, Vol. 3 No. 1. The Journal was published by the Trademarks, Patents and Designs Registry in Nigeria on December 31, 2013. TM Watch No. 14 highlights some of the marks advertised in Class 9 and Class 28. Specifically, “Class 9: In respect of Scientific, Nautical, Surveying, Electric, Photographic, Cinematographic, Optical, Weighing, Measuring, Signaling Checking” and “Class 28: In respect of games and playthings gymnastic and sporting articles not included in other classes, decorations for Christmas trees”.
Apple Inc. Applies to Register “Macbook”, “Flyover”, “Earpods” and “Cocoa” in Class 9 in Nigeria
Apple Inc. has lodged separate applications for the registration of the terms “Macbook”, “Flyover”, “Earpods” and “Cocoa”, at the Trademarks, Patents, and Designs Registry in Abuja. The applications for “Macbook”, “Flyover” and “Cocoa” were filed in 2012 while the application for “Cocoa” was filed on February 5, 2013. All applications cover a list of scientific, computing and electronic devices in Class 9.
Apple has registered the term “Macbook” in Class 9 in Australia, Canada, Egypt, Israel, New Zealand, the Philippines and the U.S. Apple has also registered the term “Cocoa” in the U.S., New Zealand and Singapore, with pending applications in the Philippines and Australia.
A Google search for “Flyover” shows that it is used in connection with Apple’s map service on its iOS 6, which offers interactive 3D or satellite views of some cities. The status of all the applications in Nigeria as of December 31, 2013, was accepted and approved for publication.
Samsung Applies to Register “Smart hub and Device”, “Samsung Smart TV”, “Samsung Human Interaction”, “Hi Samsung”, “Samsung Bada OS” and “Samsung Oled TV” in Class 9 in Nigeria
Samsung Electronics Company Limited (Samsung) has lodged applications for the registration of the terms “Smart hub”, “Samsung Smart TV”, “Samsung Human Interaction”, “Hi Samsung”, “Samsung Bada OS” and “Samsung Oled TV”, at the Trademarks, Patents, and Designs Registry in Abuja. All the applications were filed between November 2010 and December 2011 and cover various electronic products in Class 9.
WIPO’s Global Brand Database, shows that Samsung has also registered most of the marks in Class 9 in Australia, Canada, New Zealand, Switzerland, the Philippines and the U.S. The status of the marks in Nigeria as of December 31, 2013, was accepted and approved for publication.
FIFA Applies to Register “FULECO” in Class 28 in Nigeria
Federation Internationale de Football Association (FIFA) has filed an application for the registration of the logo for “FULECO” at the Trademarks, Patents and Designs Registry in Abuja. The application was lodged on January 11, 2013. It covers games, toys and playthings in Class 28.
A Google search for “FULECO” shows that Fuleco the Armadillo is the official mascot of the 2014 FIFA World Cup in Brazil. FIFA has registered “FULECO” in Class 28 in Australia, Switzerland and the U.S, with pending applications in the Philippines, Israel, Singapore and Canada.
The status of the mark in Nigeria as of December 31, 2013, was accepted and approved for publication.
Panasonic Applies to Register “Panasonic Ideas for Life” in Class 9 in Nigeria
Panasonic Corporation has lodged an application to register “Panasonic Ideas for Life” at the Trademarks, Patents and Designs Registry in Abuja. The application for the registration was filed on March 9, 2012. It covers a list of computing and electronic devices in Class 9.
Panasonic has registered “Panasonic Ideas for Life” in Class 9 in Australia, Canada, Egypt, Israel, the Philippines and the U.S. The status of the mark in Nigeria as of December 31, 2013, was accepted and advertised for publication.
MTN Nigeria Applies to Register “MTN Talk Talk” in Class 9 in Nigeria
MTN Nigeria Communications Limited has lodged an application for the registration of a mark and device for “MTN Talk Talk” at the Trademarks, Patents, and Designs Registry in Abuja. The application was filed on July 15, 2011 and covers electronic devices in Class 9. MTN has also applied to register “MTN Talk Talk” in Class 38 in Nigeria, in respect of telecommunications.
A Google search for the term “MTN Talk Talk” suggests that it is used in association with the provision of telephone services to customers in the rural parts of the country and allows them to make national calls and send SMS at discounted rates. The status of the mark in Nigeria as of December 31, 2013, was accepted and advertised for publication.
NBA Properties Inc. Applies to Register “Houston Rockets R” in Class 9 in Nigeria
NBA Properties Inc. has lodged an application for the registration of “Houston Rockets R” at the Trademarks, Patents, and Designs Registry in Abuja. The application was filed on October 7, 2003 and covers computing and electronic devices in Class 9.
NBA Properties Inc. has registered “Houston Rockets R” in Class 9 in Canada, Israel, New Zealand, the Philippines and the U.S. The status of the mark in Nigeria as of December 31, 2013, was accepted and approved for publication.
Orange Brand Services Limited Applies to Register “Orange” in Class 9 in Nigeria
Orange Brand Services Limited has filed an application for the registration of the logo for “Orange” at the Trademarks, Patents and Designs Registry in Abuja. The application was lodged on February 5, 2010. It covers a list of computing and electronic devices in Class 9.
The status of the mark in Nigeria as of December 31, 2013, was accepted and approved for publication.
Glaxo Group Limited Applies to Register “Ventoline” and “Torch” in Class 9 in Nigeria
Glaxo Group Limited has lodged an application to register the term “Me We World” at the Trademarks, Patents, and Designs Registry in Abuja. The application was filed on October 23, 2012 and covers computing and electronic devices in Class 9. The status of both marks in Nigeria as of December 31, 2013, was accepted and advertised for publication.
Globacom Limited Applies to Register “Biz Smart” and “Wheelz4mealz.com” in Class 9 in Nigeria
Globacom Limited (Glo) has lodged separate applications to register the terms “Biz Smart” and “Wheelz4mealz.com”at the Trademarks, Patents and Designs Registry in Abuja. The application for “Biz Smart” was filed on September 4, 2012 while the application for “Wheelz4mealz.com” was filed on January 29, 2013 and covers computing and electronic devices in Class 9. In Nigeria, the status of both marks as of December 31, 2013, was accepted and approved for publication.
