This article is part of a series that highlights some of the marks advertised in the Trademarks, Patents and Designs Journal, Vol. 3 No. 1.  The Journal was published by the Trademarks, Patents and Designs Registry in Nigeria on December 31, 2013.  TM Watch No. 15 highlights some of the marks advertised in Class 33.  Specifically, “Class 33:  In respect of Alcoholic beverages (except beers) Wines, Spirits and Liqueur.”

Diageo Applies to Register “Captain Morgan Original Spiced Gold” in Class 33 in Nigeria

Diageo Captain Morgan logoDiageo Scotland Limited (Diageo) has lodged an application for the registration of “Captain Morgan Original Spiced Gold” at the Trademarks, Patents, and Designs Registry in Abuja.  The mark consists of a pirate with a sword in his right hand and his left foot on a keg or barrel, with his left hand on his left knee, crossed swords below and the words “Original Spiced Gold”. The application was filed on May 26, 2010 and covers alcoholic beverages, wines, spirits and liqueur in Class 33.

Diageo has also registered the mark in Class 33 in several countries including Australia, Estonia, Israel, New Zealand, Singapore, Switzerland, the Philippines and the United States.

A Google search for “Captain Morgan Original Spiced Gold” shows that it is used in connection with Diageo’s rum, which is one of the largest brands of spirits in the United States.  The status of the application in Nigeria as of December 31, 2013, was accepted and approved for publication.

Phusion Projects LLC Applies to Register “Four Loko” in Class 33 in Nigeria

Four lokoPhusion Projects LLC (Phusion), a Chicago-based company, has filed an application for the registration of “Four Loko” at the Trademarks, Patents and Designs Registry in Abuja.  The application was lodged on May 18, 2012.  It covers alcoholic beverages, wines, spirits and liqueur in Class 33.

Earlier this year, Phusion announced that as part of a settlement with 20 attorney generals in the U.S., it would halt the production and sale in the U.S. of the caffeinated alcoholic beverages associated with the Four Loko mark but it would retain the brand.  Phusion has also registered “Four Loko” in Class 33 in Australia, Canada, New Zealand and the United States.

The status of the mark in Nigeria as of December 31, 2013, was accepted and approved for publication.

R & A Bailey & Co. Applies to Register “BB” in Class 33 in Nigeria

bb-logoR & A Bailey & Co., has lodged an application for the registration of the term “BB” at the Trademarks, Patents, and Designs Registry in Abuja.  The mark consists of intertwined loops forming a back-to-back stylized letter ‘B’ design.  The application was filed on July 18, 2012 and covers alcoholic beverages, wines, spirits and liqueur in Class 33.

WIPO’s Global Brand Database, shows that R & A Bailey & Co., has also registered the mark in Class 33 in Israel, Morocco, New Zealand, Singapore and Switzerland, with pending applications in Canada and the Philippines.  The status of the mark in Nigeria as of December 31, 2013, was accepted and approved for publication.

Deturcon Applies to Register “Brandy de Jerez 501 Solera” in Class 33 in Nigeria

501 soleraDeturcon S.L. (Deturcon) has lodged an application for the registration of “Brandy de Jerez 501 Solera” at the Trademarks, Patents, and Designs Registry in Abuja.  The application was filed on May 28, 2012 and covers alcoholic beverages, wines, spirits and liqueur in Class 33.

Deturcon has registered “Brandy de Jerez 501 Solera” in Class 33 in Estonia and the Philippines.

The status of the mark in Nigeria as of December 31, 2013, was accepted and approved for publication.

Baron Philippe De Rothschild S.A. Applies to Register the Non-Verbal Elements in the Logo used for Bordeaux Wine in Class 33 in Nigeria

Baron Philippe De Rothschild S.ABaron Philippe De Rothschild S.A. has lodged an application for the registration of the non-verbal elements in the logo used for its Bordeaux wine.  The mark consists of a horizontal band with five small circles above it representing a crown with five arrows angled through the crown.  The application was filed on December 4, 2012 at the Trademarks, Patents, and Designs Registry in Nigeria and covers alcoholic beverages, wines, spirits and liqueur in Class 33.

The company has also registered the mark in Class 33 in Canada and the United States, with a pending application in Israel.  The status of the mark in Nigeria as of December 31, 2013, was accepted and advertised for publication.

Dadson (UK) Limited Applies to Register “Don Pedro” in Class 33 in Nigeria

DON PEDRODadson (UK) Limited has lodged an application to register “Don Pedro” at the Trademarks, Patents and Designs Registry in Abuja.  The application for the registration was filed on February 11, 2011.  It covers alcoholic beverages, wines, spirits and liqueur in Class 33.  The status of the mark in Nigeria as of December 31, 2013, was accepted and advertised for publication.

J. Garcia Carrion, S.A. Applies to Register “Don Simon” in Class 33 in Nigeria

J. Garcia Carrion has filed an application to register “Don Simon” at the Trademarks, Patents and Designs Registry in Abuja.  The application for the registration was filed on June 21, 2000.  It covers alcoholic beverages, wines, spirits and liqueur in Class 33.  The status of the mark in Nigeria as of December 31, 2013, was accepted and advertised for publication.
