Private equity firm, Sutter Hill Ventures has filed a lawsuit in the California Northern District Court against a venture capital firm, Sutter Rock Capital for allegedly infringing its trademarks.
The plaintiff alleges that both companies invest in the same type of companies and similar names are likely to confuse consumers.
The plaintiff reportedly said that the defendant is using a similar name without authorization which has caused lots of damages, unfair competition, and confusion.
Sutter Hill reportedly said that it is one of the oldest venture capital firms still in operation and invests in the technology, healthcare, software, semiconductor, telecommunication, and consumer sectors.
The plaintiff reportedly said that Sutter Rock changed its name from GSV Capital Corp. in July 2019 claiming it provides venture capital services similar to Sutter Hill’s.
The plaintiff reportedly said that it received an email from a confused consumer asking about a Sutter Rock job posting.
The plaintiff is suing the defendant of federal trademark infringement, federal unfair competition and false designation of origin.
The plaintiff seeks a permanent injunction and payment for injunctive relief, damages, attorneys’ fees as the court deems fit.
The case is pending.
