Starr Homes LLC has filed a lawsuit in the Kansas District Court against Kansas City-based home builder, Thomson Homes and Overland Park, Kan-based architect, Team 3 Architects for copyright infringement.
The plaintiff alleges that the defendants stole a copyrighted home design that features a triangular atrium and stairs in the main room.
The plaintiff reportedly said that the award-winning design was designed by Charles James and was first used in 1996 and copyrighted in May 2004.
Starr Homes reportedly said that the defendant’s designs for their home are substantially similar to one the plaintiff built which was featured in Kansas City Homes & Style magazine as its 2016 Home of Distinction.
Starr Homes reportedly claimed that it owns the copyrights to the technical drawings and architectural work on that home.
The plaintiff reportedly said that the defendants knowingly copied its designs without permission or authorization.
The plaintiff reportedly accuses the two Kansas City-area companies of copyright infringement, contributory infringement, vicarious infringement, and unjust enrichment.
Starr Homes seek payment for damages, profits attributed to the alleged infringements, fines, attorney fees, and an order to permanently enjoin the defendants from further acts of infringement.
The case is ongoing.
