
On July 30, a Los Angeles company, Romex Textiles Inc. filed a lawsuit in the U.S. District Court for the Central District of California against HK Worldwide LLC, doing business as Hot Kiss; Apollo Apparel NY LLC; Burlington Stores Inc.; Ross Stores Inc. and Does 1-10 alleging copyright infringement.
The plaintiff alleges that the defendants infringed on its copyrighted textile artwork for textiles without permission.
The plaintiff claims that he owns a two – dimensional artwork which is titled AE_T1697 for use on textiles which the defendant infringed upon by manufacturing, selling the garments with fabric that has a design identical to the plaintiff’s design.
The plaintiff argues that the defendants had caused damages, unfair competition and customer’s confusion.
The plaintiff requests a trial by jury and seeks judgment against defendants, award all profits of the defendants plus all other benefits, profits, costs of attorney and all others the court deem fit.
The case is currently pending.
