
American photographer and a former chief photographer at Rolling Stone magazine, Baron Wolman has filed a lawsuit in the New York Southern District Court against Universal Music Group (UMG) for allegedly using his protected image of jazz musician, Sun Ra without permission.
According to the lawsuit, the plaintiff alleges that Universal Music Group published an article on its UDiscoverMusic website, which featured Wolman’s copyright-protected image of jazz musician, Sun Ra without permission.
Wolman claims that the article featured a photo he took of Sun Ra in 1992, which was registered with the U.S. Copyright Office in 2010 with registration number VA 1-726-336.
Wolman reportedly said that Universal Music did not license the photograph for its article, nor did Universal Music have Wolman’s permission or consent to publish the photograph on its website.
It will be recalled that this is the third copyright infringement lawsuit filed in the U.S. by Wolman this year over the use of his photographs online.
Wolman is seeking costs and attorneys’ fees plus damages and profits attributable to Universal Music Group’s use of the photograph, or alternatively, statutory damages of up to $150,000 plus.
The case is ongoing.
