Hajiya Habiba Aliyu has filed a lawsuit in the Federal High Court, Kano against a textile firm and five others for alleged infringement on the rights of her deceased daughter, Nafisa Aliyu.
The plaintiff alleges that the defendant is using her late daughter’s pictures and artworks on their textile materials without permission or authorization.
The plaintiff reportedly accused the defendants of copying the artwork of her late daughter from Facebook and using same on its textile for financial benefits.
The plaintiff reportedly argued through her counsel, Aliyu Suleiman-Jatau that the selling, marketing retailing, and distributing of Mudatex Textiles Materials and products of the other four defendants with the artwork pictures of her deceased daughter infringed on her rights.
Other defendants in the suit are a Chinese national, Ms Ling Haiying; Hongkong Runda Textile Company Limited, Mudatex Brothers, Dan Kano and Sani Tahir.
The plaintiff alleges that the infringement has caused lots of damages, confusion and false designation of origin.
The plaintiff is seeking N250m damages against the defendants for alleged infringement on the rights of her deceased daughter, Nafisa Aliyu.
The presiding judge, Justice Sa’adatu Ibrahim-Mark, adjourned the case till December 11, 2020, to hear the preliminary objection.
The case is ongoing.
