On October 24, 2014, a Federal High Court in Lagos presided over by Honourable Justice O.E. Abang struck out Suit No. FHC/L/CS/377/2013 filed by the Musical Copyright Society of Nigeria (MCSN) against the Copyright Society of Nigeria (COSON) and the Nigerian Copyright Commission.
MCSN had filed the suit on March 22, 2013 seeking an order to restrain the COSON from parading itself as Nigeria’s sole Collective Management Organization (CMO) for musical works and sound recordings.
MSCN also challenged the approval of COSON as a sole CMO on grounds of fraudulent representation and total disregard of the provisions of the Copyright Act, the Copyright Regulations of 2007 and the 1999 Constitution of the Federal Republic of Nigeria as amended.
