
New Balance Athletics Inc, has filed a lawsuit in the U.S. District Court for the District of Massachusetts against an athleticwear maker, Balance Athletica LLC’s for trademark infringement.
The plaintiff alleges that the defendant is using a similar name without permission or authorization.
The plaintiff reportedly said that the use of the name is likely to cause consumer confusion with the footwear and apparel brand.
The plaintiff reportedly said that the defendant use of “Balance” to sell similar lines of goods to same customer base via same channels has caused unfair competition and consumer conflict.
The plaintiff alleges that it owns the trademark and have been using the name for quite a time.
The plaintiff reportedly accused the defendant of contributory trademark infringement, false designation of origin, false and misleading representations and trade dress infringement.
The plaintiff reportedly said that the infringement has caused lots of damages, confusion and false designation of origin.
The plaintiff seeks a jury, permanent injunction and payment for damages and others as the court deems fit.
The case is ongoing.
