U.S. New | Level Up Sues Level Up Arcade Bar for Trademark Infringement

An Oregon business, Level Up, LLC has filed a lawsuit in the Washington Eastern District Court against Level Up Arcade Bar in Kennewick for trademark infringement.

The plaintiff alleges that Level Up Arcade Bar is using a similar name with the plaintiff without permission.

The plaintiff reportedly said that it has exclusive rights to the name “Level Up” which has been trademark covering entertainment and gaming services for amusement arcades, bars, and cocktail and restaurant services.

Level Up alleges that the infringement has caused lots of damages, unfair competition and confusion as the plaintiff have received phone calls and Facebook messages from confused customers.

Level Up seeks permanent injunction stopping Level Up Arcade from using the name plus payment for damages and the reimbursement of attorney fees.

The case is ongoing.
