U.S. News | Kansas City Photographer Sues Leawood Law Firm for Copyright Infringement


Eric Bowers, a Kansas City photographer, has filed a lawsuit in U.S. District Court in Kansas against Leawood law firm alleging copyright infringement over a photo posted on the firm’s website without permission.

According to the lawsuit, Eric Bowers who is a professional photographer offering architectural, real estate and commercial photography services with a specialty in aerial photography created a photograph in 2017 depicting the Kansas City skyline at dusk, looking up Main Street from a high vantage point in the Crossroads Arts District.

Eric Bowers reportedly said that the photo was created using a series of photographs and was edited digitally with retouched lighting to enable the buildings appear more bright and colorful with minimal lighting.

The plaintiff claims that the photograph was registered with the U.S. Copyright Office on March 29, 2017.

Eric Bowers accused the Leawood law firm of using the photograph in her website as a background which was blurred out with text placed on top of it without permission and displaying it as part of the law firm’s website to advertise and promote its legal services.

Eric Bowers alleges that the law firm infringed on its copyright four times in 2019 and was notified to settle the case mutually but the firm refused to respond and continued the use of the photograph for at least a month after being notified.

Eric Bowers is seeking actual damages and profits attributable to the infringement, as well as attorney fees and costs.

The Case is ongoing.
