In May, commerce corporation, Jitrade Inc. filed a suit against a Florida business, Giti Online Inc., Edward Chong and Does 1-10 in the U.S. District Court for the Central District of California with case number 2:18-cv-04276-DSF-AFM alleging that they violated the United States Copyright Act for manufacturing garments with the plaintiff fabric design without authorization.
The plaintiff alleges that the defendants unlawfully used one of its textile designs without their consent.
According to the suit, the plaintiff alleges they own the unique two-dimensional graphic artwork for use on textiles and garments titled “SND1412_3” which was infringed by the defendants.
The plaintiff express her dissatisfaction on the infringed design that it has caused serious damaged and unfair competition due to the defendant allegedly manufactured and supplied garments consisted of fabric printed with plaintiff’s copyrighted design.
Jitrade requests a trial by jury and seeks an award for all profits of defendants plus all losses of plaintiff, attorneys’ fees, costs, prejudgment interest and such other legal and equitable relief.
The case is currently pending.
