Hearing Scheduled in NCC v. MTN Nigeria Case in spite of Out of Court Settlement

NCC v. MTNAbuja, Nigeria — A Hearing Notice has been issued by a Federal High Court sitting in Abuja, in Case No. FHC/ABJ/CR/379/2015 filed by the Nigerian Copyright Commission (NCC) against Nigeria’s largest telecommunication provider, MTN Nigeria Communications Ltd., and another.

It can be recalled that NCC had commenced criminal charges against MTN following MTN’s alleged infringement of copyright in songs belonging to musician Baba 2010. The musician had filed a civil suit against MTN but the parties had settled out of court. Following the commencement of the Criminal charges, the musician through his lawyers had sent a formal letter to the Nigerian Copyright Commission asking the Commission to drop the charges.

The Hearing Notice, issued on January 14, states that the criminal case is scheduled to be held 9am on Wednesday, January 20, at the Federal High Court in Abuja.
