U.S. News | Fresno Grain Company Accuses Global Natural of Breach of Contract

Penny Newman Grain Co., a Fresno County grain company, is suing Global Natural in the U.S. District Court for the Eastern District of California, Fresno Division with case number 1:18-cv-00193-LJO-SKO alleging breach of contract and refusal to pay more than $240,000.

According to the complaint, on Feb. 3, 2017, and on March 23, 2017, Penny Newnan Grain entered into a contract agreement with defendant to sell and deliver organic cottonseed for which Global Natural agreed to pay the contract prices. Penny Newman Grain says it has performed all promises, covenants and conditions required under the agreement but it has failed to receive payment amounting to $241,455.25.

Penny Newman Grain Co. alleges that the defendant has breached the contract, neglected and failed to pay in full for the organic cottonseed delivered.

Penny Newman Grain seeks trial by jury, damages of $241,455.25, prejudgment interest, attorney fees, costs of suit and all other relief the court deems just and proper.

The case is currently pending.
