Earlier this year, we reported that the Trademarks, Patents and Designs Registry in Nigeria published six new Trademarks Journal dated January 30, 2018. The Journal titles ranged from Volumes 1 to 6 and covered trademark applications filed using the registry’s online filing system.  The Deadline for filing opposition to those applications was earlier this month.

It appears, the Registry has now published four additional volumes of Trademarks Journal, including three online volumes — 7, 8, and 9, dated April 24, 2018. This is a welcome improvement as it brings the total volumes of trademarks published in 2018 to 10 volumes and we are only midway through this year.

Each Journal typically contains about 4,000 trademark applications and three of the journals cover trademarks filed online using the Registry’s online filing system while one journal covers trademark applications filed manually through paper applications.

Surprisingly, the journals include some marks filed as early as last year. This is a rather encouraging step from the Registry as the delay with the publication of marks in Nigeria has over the last two decades been one of the biggest challenges with completing the trademark registration process.

Pursuant to section 19 of the Trademark Act, the Trademarks Registry in Nigeria through the publication of this trademark journal gives notice to the public that applications have been received for registration of the marks contained in the journals.

Any person who has grounds of opposition to the registration of any of the marks advertised in the journal has approximately two months from the date of publication to register their opposition.

Such notice should be filed in writing (in duplicate) and set out the grounds for opposition.

The Journals contain marks published in Classes 1-34 of schedule 4, and service marks in classes 35-45.

All communications relating to Trade Marks should be addressed to the Registrar of Trademarks, Federal Ministry of Industry, Trade and Investments, P.M.B. 88, Garki, Abuja, Nigeria.
