Ferodo Limited v. Unibros Stores

In 1980, the first Anton Piller order granted in Nigeria was made by Anyaegbunam C.J. in Ferodo Limited v. Unibros Stores relying on the decision of the English Court of Appeal in Anton Piller KG v. Manufacturing Processes Ltd. [1975] EWCA Civ 12.

PRINCIPLE ESTABLISHED

Where a Plaintiff shows a strong prima facie case that a property which is the subject matter of the suit, is in the possession of the Defendant and that the Defendant may destroy it if he had notice of the proceedings, an Anton Piller order may be granted.
