Copyright Infringement, Software Piracy, Illegal Sale of Software — The Federal High Court had to decide on whether Genuss Investment Ltd. was guilty of software piracy.


The Nigerian Copyright Commission (NCC) instituted an action against the accused, Genuss Investment Ltd. The accused was charged with the infringement of software in which copyright belonging to another subsisted.


The accused was convicted by the Federal High Court in Lagos.  Justice Idris, delivering judgement on June 16, 2012 in charge No. FHC/L/460C/2011, convicted the accused of software piracy and imposed a fine of N11,000.

The Prosecution Counsel for the NCC was Douglas Najime Esq. while the Counsel for the accused was E.C. Ojiako, Esq.
