
A San Francisco-based digital currency venture, Blockchain Capital, LLC has filed a lawsuit in the Middle District of Florida against a Florida-based company, Blockchain Capital Management LLC (BCM), and its founder, Fareed Iftikhar for state and common law trademark infringement.
The plaintiff alleges that the defendant is using a similar name without permission or authorization and that the use of the name is likely to cause confusion to customers and investors.
The plaintiff reportedly claimed that since when the company was founded in 2013 by Bart Stephen and Brock Pierce, it has been using the name and has the exclusive right to use the name in the venture capital and financial services industry.
The plaintiff reportedly said that the company has gained distinctiveness, substantial press, and recognition due to its partners’ individual exploits and the company’s successful investments.
The plaintiff reportedly said that it has written to BCM requesting a name change in the past but they continued using the mark.
The plaintiff reportedly said that the defendant’s use of a similar name has caused confusion, mistake, or deception among the public to believing BCM is affiliated with, endorsed by, or authorized by Blockchain Capital
The plaintiff seeks a jury, permanent injunction, and payment for damages.
The case is ongoing.
