The American Automobile Association (AAA), a shipping company is suing the Rochester-area AAA Logistics (the defendant), a freighting and shipping company alleging violation of trademark law with its use of AAA in its name and in insignia on its trucks.

The AAA alleges that they have approached AAA Logistics about the use of AAA in its name and in insignia on its trucks but the defendant has continued with the use of the infringed mark even after claiming it would no longer use it and that it would remove it from its trucks.

The attorney for AAA, Neil Roman, has said that AAA doesn’t want to litigate and that the plaintiff seeks to stop the defendant from using AAA on its trucks and everywhere else, including “literature, signs, labels, prints, packages, wrappers, containers, advertising materials, Internet content, stationery, software, and any other items in its possession or control which contain the infringing designations ‘AAA,’ or any term confusingly similar to ‘AAA,’ either alone or in combination with other words or symbols.”

“Typically AAA has an aggressive enforcement program for the AAA trademark and would go after businesses that use AAA trademark to confuse consumers” Roman said
